ST. ALBANS, Vt. \u2014<\/strong> A Richford man was cited after allegedly assaulting a corrections officer while being admitted to the Northwest State Correctional Facility, according to the Vermont State Police.<\/p>\n\n\n\n

Police identified the accused as Brian Clair, 43, of Richford. The corrections officer was identified as Elijah Dunker, 22.<\/p>\n\n\n\n

According to a state police news release, troopers transported Clair to the correctional facility at about 10:20 p.m. July 13. Police said Clair assaulted Dunker while at the facility.<\/p>\n\n\n\n

The release did not describe the nature of the alleged assault, whether a weapon was involved or whether Dunker required medical treatment. Police also did not disclose why Clair was initially being transported to the correctional facility.<\/p>\n\n\n\n

Clair was issued a citation to appear in Franklin County Criminal Court at 8 a.m. Aug. 25 to answer to a charge of assault on a corrections officer.<\/p>\n\n\n\n

Under Vermont law, alleged assaults involving correctional employees can carry enhanced criminal consequences because of the victim\u2019s duties and position. The specific penalty in any case depends on the charge filed, the evidence presented, the defendant\u2019s criminal history and the ultimate decision of the court.<\/p>\n\n\n\n

The incident was investigated by Sgt. Andrew Underwood of the Vermont State Police St. Albans Barracks.<\/p>\n\n\n\n

Northwest State Correctional Facility, located in St. Albans, is operated by the Vermont Department of Corrections and houses people awaiting court proceedings as well as individuals serving sentences. State police are commonly called to investigate alleged crimes occurring inside state correctional facilities.<\/p>\n\n\n\n

No booking photograph was released with the police statement.<\/p>\n\n\n\n

The charge remains an allegation. Clair is presumed innocent unless and until proven guilty in a court of law.<\/p>\n\n\n\n
